I am adding a director to an existing company which has mortgages, this means the new director will need to sign a deed of guarantee for one of the existing mortgages, the lender that requires this is The Mortgage Works. The mortgage company requires a SRA registered solicitor to give legal advice to the new director so they understand why they are signing a personal guarantee. We are aware the reason for this deed is due to the case of Royal Bank of Scotland v Etridge (No 2) . I'm not even sure if this is possible remotely as the new director will need to sign the deed, I believe the solicitor will also need to sign and have their SRA No. on the document so someone local between south Leeds to Doncaster would be ideal so this could be signed in person in wet ink. We do have a few months before the current mortgage deal (July) expires so there's no real urgency.
